Introduction

Local authorities keep record of people who are qualified for social housingsupport and who have not received it. As social housing becomes available, thelocal authority allocates it to people who are on its record of qualifiedhouseholds – more commonly known as the housing list.

Before offering you accommodation, the local authority reviews itsassessment of your application and confirms that your household stillqualifies. Local authorities must review all applications on their housinglists each year and prepare a summary report - see 'Summary of social housingassessments' below.

As well as the main housing lists, local authorities also maintain lists ofpeople who have applied for atransfer from their current accommodation. There is also a transfer listfor people on the Housing Assistance Payment (HAP) who want to be consideredfor social housing.

Rules

Getting on the social housing list

When you apply forsocial housing, the local authority assesses your application to determineyour household’s eligibility and need for social housing. If you qualify,your details are placed on the housing list. The local authority will alsonotify any other local authority in whose area you have specified an area ofchoice.

While you are on the housing list

Each local authority draws up its own rules for deciding the order ofpriority on the housing list. These are called allocation schemes andare generally published on the local authority’s website.

Some local authorities operate a points system, giving each household on thelist a number of points depending on its circ*mstances. If your circ*mstanceschange – for example, you have a new baby – you should tell the localauthority so that it can update your household’s record. You should also tellthe local authority if your address has changed since you went on the housinglist.

If you want to know your position on the housing list, ask the localauthority. Your position may go up or down depending on the circ*mstances ofother people on the list and as your own circ*mstances change. In practice,priority is generally given to families and older people rather than singlepeople or couples without children.

Renting privately

If you are in private rented accommodation while waiting for local authorityhousing, you may be eligible for the Housing AssistancePayment (HAP), which has been introduced to replace long-term RentSupplement. If you are housed under HAP, your housing need will have beenmet and you will no longer be on the local authority’s housing list. However,if you still want to be considered for social housing you can apply to beplaced on the local authority's transfer list.

If you apply for a transfer within 2 weeks of getting the letterconfirming your HAP payment, any time that you spent on the housinglist can be taken into account when your local authority considers yourapplication. If you apply for a transfer at a later date, the time that youpreviously spent on the housing list will not count.

Allocation of housing

General allocation process and refusing and offer

In general, as houses and flats become available, they are allocated fromthe housing list in order of priority. However, local authorities can alsoallocate a portion of their social housing using a system of choice-basedletting, see 'Choice-based letting allocation process' below.

When the local authority is planning to offer you accommodation, it mustreview its assessment of your household’s eligibility and need for socialhousing. It must also confirm that your application is still valid, forexample, it will check that you still have a connection with the area.

If you have chosen to be considered for accommodation provided by a housing association or other approvedhousing body (by ticking the 'approved housing body (AHB)' box on thesocial housing application form) one of these organisations may contact you ifsuitable accommodation becomes available.

If you are offered a house or flat that you do not want, you can refuse itwithout affecting your place on the housing list. However, if the localauthority thinks that you do not have a good reason for refusing the offer, itmay reduce your priority on the list. If you refuse more than one reasonableoffer in any 12-month period, you will be suspended from the list for 12months, during which you cannot claim Rent Supplement.

Choice-based letting allocation process

Local authorities can allocate some of their social housing using adifferent system called choice-based letting (CBL). This system lets localauthorities advertise some of their social housing so approved social housingapplicants can express their interest in the available properties.

Local authorities will advertise CBL properties when they are available. Theproperties can be viewed on the local authorities website, and they may also beadvertised in the media. The advertisem*nts include information about:

  • The location of the home
  • The type of home, for example, a two-bedroom flat
  • The type of household that can apply for the home, for example, a single-person household
  • The floor plan or photographs of the home
  • The house rules
  • The closing date for expressing your interest in the property (this is usually a few weeks)

Local authorities can restrict CBL applications to qualified people whoselected the location of the advertised property as an area of choice on theirsocial housing application. The property advertisem*nt will state if thisrestriction applies.

If you want to express your interest in a CBL property, the propertyadvertisem*nt will provide information about how to apply. You can also contactyour localauthority for information.

If a number of qualified people express an interest in a CBL home, the homewill be allocated in line with the local authorities’ allocation scheme.

If you are offered a house or flat under the CBL system and you refuse it,you will not be able to apply for a CBL property for 12 months. This will notaffect your position on the housing list.

Refusal to allocate housing

If you or a member of your household has previously been in local authorityhousing, the housing authority will not allocate housing to you if you or ahousehold member have done any of the following:

  • Damaged a dwelling or site previously provided by any housing authority, without repairing the property or paying for repairs
  • Breached the terms of a local authority tenancy agreement, leading to the authority ending the tenancy
  • Built up rent arrears for 12 weeks or more in any period of 3 years as a local authority tenant, without either paying them off or arranging to pay them

However, the SocialHousing Assessment (Amendment) (No. 2) Regulations 2011 allow localauthorities, in exceptional circ*mstances, to consider providing social housingsupport to households in the first two situations outlined above.

Summary of social housingassessments

Every year each local authority must prepare a summary of the social housingassessments carried out in its area. They contact all households on theirhousing lists to confirm that they still qualify for social housing support.They also request information about income, family size and current housingconditions. It is important for all households to respond to the localauthority in good time with the details requested. If your address has changedsince you went on the housing list, you should contact the local authority andgive your current address.
