Who is the boss of a district? The Collector or SP? This is an oft repeated question which arises whenever there is a clash over the powers one wields. The Collector is also described as the District Magistrate and he is the custodian of law and order. But it is seen that the Collector and the SP head two different power centres. Only a very strong Collector normally prevails over an SP.
Till 1965, the Annual Confidential Report (ACR) of the SP was written by the Collector and that of the Deputy SP by the SDM. Thus in administrative set up, the SP was under the thumb of the Collector. But this system was done away with in 1965. But when Harideo Joshi was the Chief Minister, he saw that usually the Collectors and SPs clash with each other over administrative matters. Thus Joshi on the advise of the then chief secretary Sundar Lal Khurana, ordered that the system which prevailed before 1965 should be enforced meaning that the Collectors would write the ACR of the SPs. But within two days, the police force reacted very sharply against Joshi's decision and the orders were withdrawn and the old system reinforced. Thus Collectors lost administrative control over SPs. The Collectors have the powers to change the SHO, but practically the Collectors are not allowed even to change a constable. The Nainwa incident is a simple example of the clashes between police and civil administration.
